課程概述

Taiwan Constitution in Context aims at exploring the dynamic transition and transformation of Taiwan Constitution. The transition to democracy was made possible by incremental constitutional revisions, responsive courts to changing circumstances, and a civil society engaged in the project of constitutional transformation. In addition to these elements, democratization, indigenization, and globalization all drove the transformation of an externally imposed constitution into an internally embraced, vibrant constitution. These changes ushered in the unprecedented development of a transitional and transnational constitutionalism. The rather quiet and peaceful process of constitutional transformation was considered a phenomenal achievement by the world, making Taiwan a prominent example of studying. Deeper understanding of the key historical, political and legal events is important to shape the comprehensive constitutional landscape of Taiwan. Therefore, the course will focus not only on constitutional text, but also on constitutional context.


It is highly encouraged to participate, interact, and discuss in class. To better grasp the essence of Taiwan Constitution in context, some landmark cases and events will be introduced and deeply discussed during the lecture sessions. Case studies and viewpoints exchange are important parts of the course. Therefore, there will be two sessions of class forum, in which students are required to conduct the comprehensive case study of selective landmark cases of Taiwan Constitution. They are JY Interpretations No.520 and JY Interpretations No. 748 respectively. Through the process of deep class discussion and debate, it will get the students to better grasp the idea of constitutional development of Taiwan in context. 

課程目標
After finishing the course, it is expected that the participants will have the capacity of illustrating the transformation of Taiwan Constitution and its salient features in English. Most importantly, this goal will be achieved with interesting, innovative and interactive ways.

The course is coducted in English and open to all stuedents who are interested in the topic.
